FBI Warrant Reveals Classified Documents Seized from John Bolton's Office in Ongoing Probe

The D.C. office warrant, dated August 22, sought evidence of three felonies: unauthorized retention of national defense information (18 U.S.C. § 793(e)), gathering or transmitting national defense information (Espionage Act, 18 U.S.C. § 793), and willful communication of classified information to unauthorized persons (18 U.S.C. § 952).

A federal search warrant executed at former National Security Adviser John Bolton's Washington, D.C., office uncovered documents marked "secret" and "confidential," according to court filings unsealed this week. The FBI is investigating Bolton for alleged mishandling of national defense information, with agents also seizing laptops and other electronics during the August 22 raid.

Case Background

Bolton served as national security adviser to President Trump from April 2018 to September 2019. In June 2020, he published the memoir "The Room Where It Happened," prompting the Justice Department to sue, alleging violations of nondisclosure agreements and unauthorized disclosure of classified information. A federal judge ruled Bolton owed the government $2 million in book proceeds but did not pursue criminal charges. The Biden-era probe ended in June 2021 without indictment.

Following President Trump's January 2025 inauguration, Bolton's security clearance was revoked. The FBI reopened the investigation, focusing on Bolton's use of a private AOL email account—hacked by a foreign entity in 2019—to send classified materials to family members and associates. On August 22, agents raided Bolton's Maryland home and D.C. office under warrants authorized by a federal judge. Vice President JD Vance described the probe as in early stages and unrelated to politics.

Details from the Warrant

The D.C. office warrant, dated August 22, sought evidence of three felonies: unauthorized retention of national defense information (18 U.S.C. § 793(e)), gathering or transmitting national defense information (Espionage Act, 18 U.S.C. § 793), and willful communication of classified information to unauthorized persons (18 U.S.C. § 952). Inventory lists include "travel memo documents with pages labeled secret," confidential files on the U.S. Mission to the United Nations, a U.S. Government Strategic Communications Plan, and weapons of mass destruction topics. A separate warrant for Bolton's home yielded additional classified materials.

Potential Charges and Penalties

If charged, Bolton could face:

  • Unauthorized retention (18 U.S.C. § 793(e)): Up to 5 years imprisonment and fines.
  • Espionage Act violations (18 U.S.C. § 793): Up to 10 years per count.
  • Willful communication (18 U.S.C. § 952): Up to 10 years.

No charges have been filed; the investigation continues under FBI Director Kash Patel.
