A federal grand jury in the Eastern District of Virginia indicted New York Attorney General Letitia James on Thursday on one count of bank fraud, stemming from allegations she falsified mortgage documents in 2023 to secure favorable loan terms on a Virginia property.

The charges, unsealed Thursday, accuse James of misrepresenting the Norfolk home as her primary residence to obtain a lower interest rate and altering property descriptions to qualify for government-backed assistance, per the criminal complaint. Federal Housing Finance Agency Director Bill Pulte referred the matter to the Department of Justice in April 2025, citing media reports of multiple instances where James allegedly "falsified bank documents and property records" for benefits. Evidence includes loan applications showing the residence status discrepancy, which James's lawyer described as an "error" quickly corrected without lender deception.

James was elected in 2018 after campaigning on investigating President Donald Trump. President Trump has faced James's legal actions since her tenure began. Her office filed a 2022 civil fraud suit against him and his companies, securing a $454 million judgment in February 2024 for inflating asset values—a ruling partially reversed by a New York appeals court in August 2025, which voided the penalty as excessive under the Eighth Amendment.

Democrats, including Senate Majority Leader Chuck Schumer, decried the indictment as "weaponization of the Justice Department against political enemies," echoing claims of Trump's retaliatory probes against foes like former FBI Director James Comey, indicted September 25 on false statements charges. Yet James's career trajectory centered on targeting Trump: her 2018 campaign pledged to "champion" investigations into his businesses, leading to the 2022 suit and multiple probes into his New York operations.

Interim U.S. Attorney Lindsey Halligan presented the case; James faces up to 30 years if convicted, though no trial date is set. Eric Trump, son of the president, called it "the ultimate irony" on Newsmax, noting James sued his family over alleged mortgage misstatements while now facing similar accusations. The case originates from Pulte's referral highlighting discrepancies in James's 2023 loan for a $1.1 million Norfolk property, where she claimed primary residency despite maintaining her Brooklyn home.
