Border Patrol Enforces $5,000 Apprehension Fee on Illegal Immigrants Entering Without Inspection

U.S. Border Patrol Chief Michael Banks announced on December 5, 2025, that illegal immigrants ages 14 and older apprehended for entering the United States without inspection will face a $5,000 apprehension fee under 8 U.S.C. §1815.
The policy, effective immediately, applies universally regardless of entry location, duration in the U.S., current residence, or involvement in immigration proceedings. Additional penalties under 8 U.S.C. §§2339 and 1324 target smuggling and harboring activities.

The measure stems from President Trump’s "One Big Beautiful Bill," signed into law in July 2025, allocating $170 million over four years for enhanced immigration operations. It complements daily fines that accrue as high as $1,000 per day in some cases—with 21,500 such notices issued by late August that have accumulated to $6.1 billion in total penalties.
Department of Homeland Security data shows seven consecutive months of zero Border Patrol releases into the U.S., marking the longest such period in history and affirming the border as the most secure under President Trump and Secretary Kristi Noem.
